Terms and Conditions
These Terms and Conditions govern the use of the BBMh website and the services provided by BeanBag Media House LLP (“BBMh”, “we”, “us”, or “our”). By using our website, contacting us, requesting a quotation, approving a proposal, or starting a project with BBMh, you agree to these Terms and Conditions.
BBMh is a Mumbai-based creative studio providing services including brand identity, logo design, website design, website revamp, e-commerce websites, web apps, company profiles, catalogues, brochures, motion graphics, video editing, video production, 3D animation, AI image and video generation, automation, and brand consultation.
The content on this website is provided for general information about BBMh, our services, selected work, process, and creative capabilities.You agree not to misuse the website, attempt unauthorised access, copy protected material, disrupt website functionality, or use our content, visuals, work, or brand assets without written permission.
Submitting an enquiry does not create a project agreement.All project scopes, pricing, timelines, deliverables, payment terms, third-party costs, and responsibilities are confirmed through written quotation, proposal, contract, invoice, or mutually approved communication.
A project begins only after quotation approval, required advance payment, and completion of contract or onboarding formalities.
BBMh will deliver only the services, pages, assets, features, formats, and deliverables agreed in writing.
Any additional requirements, new features, extra pages, major redesigns, additional formats, advanced functionality, extra revisions, production requirements, third-party integrations, or scope changes may be quoted and billed separately.
To ensure smooth project execution, the client is responsible for providing required information, content, references, approvals, access, and assets on time. This may include business details, brand information, website content, product or service information, images, videos, logos, and documents, legal, medical, financial, technical, or compliance-related content where applicable, domain, hosting, Shopify, CMS, analytics, payment gateway, or platform access, and timely feedback and approvals.
Delays in content, access, feedback, or approvals may extend project timelines.
The client is responsible for the accuracy, legality, originality, approval, and compliance of all content, claims, images, videos, testimonials, product information, medical statements, financial statements, legal text, disclaimers, certifications, and documents shared with BBMh.BBMh may design, structure, edit, implement, or present client-provided content, but we are not responsible for verifying legal, medical, technical, financial, regulatory, or compliance claims unless separately agreed in writing.
BBMh follows a structured project process that may include direction drafts, refinement drafts, and final drafts depending on the project scope.Feedback must be clear, consolidated, and shared within the agreed review period. Once a draft, design, page, brand direction, or final output is approved, further changes may be treated as additional scope and billed separately.
Final approval through email, WhatsApp, written message, or approved project communication may be considered valid approval.
Project timelines depend on scope, content readiness, platform requirements, approval speed, product count, page count, technical complexity, third-party dependencies, and client responsiveness.
Any delay in receiving required content, access, feedback, payment, approvals, or third-party confirmation may proportionally shift the project timeline.BBMh is not responsible for delays caused by third-party platforms, domain providers, hosting providers, Shopify, payment gateways, plugins, software tools, or external vendors.
Payment terms are defined in the approved quotation, invoice, proposal, or contract.Work may be paused if payments are delayed. Final deliverables, website launch, handover, files, or access may be withheld until pending payments are cleared.
Applicable taxes, transaction charges, currency conversion charges, or bank charges may apply as per the invoice and payment method.
Unless specifically included in writing, the client is responsible for third-party costs such as domain purchase and renewal, DNS or domain protection, hosting subscriptions, Shopify subscription, paid plugins or apps, stock images, videos, music, fonts, or licenses, payment gateway charges, third-party software subscriptions, APIs, automation tools, or external integrations.
BBMh may assist with setup or integration, but ownership and payment of third-party tools usually remain with the client
Where applicable, BBMh may assist with website setup, hosting setup, domain connection, CMS setup, Shopify setup, payment gateway linking, analytics setup, or basic technical configuration.
Domain ownership should remain with the client unless separately agreed. Clients are responsible for maintaining access to their domain, hosting, Shopify, email, payment gateway, and related business accounts.
BBMh is not responsible for loss of access, expired subscriptions, platform restrictions, third-party downtime, or issues caused by changes made outside BBMh’s control.
BBMh may provide basic on-page SEO structure such as page titles, meta descriptions, heading hierarchy, image alt text, clean page structure, and SEO-friendly content direction where included in scope.
BBMh does not guarantee search rankings, website traffic, sales, enquiries, conversions, ad results, social media growth, or marketing performance.
BBMh does not provide social media management, paid ads, Google Ads, sales campaigns, or promotional marketing services unless separately agreed in writing.
Where AI image or video generation is part of the project, BBMh will use such tools for concept visuals, website visuals, campaign-style assets, pitch visuals, or commercial creative assets as agreed in scope.
AI outputs may be influenced by tool limitations, platform rules, licensing terms, and usage policies. BBMh does not guarantee exclusivity of AI-generated styles, concepts, or outputs unless separately agreed.
Final approved deliverables are transferred to the client only after complete payment is received. Client-provided materials remain the client’s property and responsibility.Unless specifically included in writing, editable source files, working files, raw project files, Figma files, After Effects files, Photoshop files, Illustrator files, Framer remix files, raw footage, or internal process files are not included in the final delivery.
BBMh may showcase completed work, non-confidential project visuals, case studies, or selected outcomes in its portfolio, website, social media, presentations, and marketing material unless otherwise agreed in writing.
Both parties agree to maintain confidentiality of non-public business, project, financial, strategic, technical, and commercial information shared during the project.
Confidentiality does not apply to information that is publicly available, independently developed, already known, or required to be disclosed by law.
Advance payments are generally non-refundable once work has begun.If a project is cancelled mid-way, BBMh may invoice or retain payment for completed work, work-in-progress, planning, design, development, coordination, third-party costs, and time already invested.
No refunds apply after final approval, delivery, or launch.
Post-launch support, if included, is limited to minor bug fixes, minor technical checks, or agreed support duration.
Post-launch support does not include redesigns, new features, major content changes, new pages, third-party platform issues, data recovery, marketing work, SEO ranking work, or changes caused by client-side edits unless separately quoted.
BBMh is not liable for indirect losses, business losses, revenue loss, data loss, third-party platform issues, legal claims arising from client-provided content, loss caused by delayed approvals, or issues outside our reasonable control.
Our responsibility is limited to the agreed project scope and the amount paid for the specific service giving rise to the claim, to the maximum extent permitted by law.
Both parties agree to first attempt to resolve any concern or dispute through mutual good-faith discussion.If unresolved, disputes shall be subject to the jurisdiction of courts in Mumbai, Maharashtra, India, unless otherwise agreed in writing.
BBMh may update these Terms and Conditions from time to time. Updated terms will be posted on this page with the latest revision date.
